This is my third letter to LVNV regarding the above account that is being reported on my credit reports. This is the third notice pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and full deletion of the trade line is requested
Here are just some of the violations of LVNV:
-LVNV violated 15 USC §1692e by making false or misleading representations concerning the status of the alleged debt by the following actions:
-LVNV violated 15 USC §1692e(2)(A) by misrepresenting the amount of the debt and by incorrectly characterizing the account as belonging to a “factoring company”.
-LVNV violated 15 USC §1692e(8) by communicating credit information which is known or which should be known to be false by reporting the account as a “factoring company” account and by reporting the account status as “open”
-LVNV violated 15 USC §1692e(10) by using false representation or deceptive means to collect or attempt to collect any debt by reporting the account as a “factoring company” account
-LVNV violated 15 USC §1692e(12) by alleging that the account was a “factoring company” account resulting in the false representation or implication that accounts have been turned over to innocent purchasers for value.
LVNV violated 15 USC §1692f by using unfair or unconscionable means to collect or attempt to collect any debt by reporting the account as a “factoring company” account to deceive current and potential creditors and to negatively impact my credit scores.
LVNV has reported incorrect and damaging information concerning the alleged debt to credit reporting agencies in violation of the Fair Credit Reporting Act [15 U.S.C. § 1681 et seq.]
LVNV violated provisions of the Fair Credit Reporting Act [15 USC §1681s-2(] by failing to properly investigate this matter in response to disputes filed with the credit reporting agencies. LVNV reported inaccurate and/or erroneous information as “verified”..
At this time I will also inform you that if your offices have reported invalidated information to any of the 3 major Credit Bureau’s (Equifax, Experian or TransUnion) this action might constitute fraud under both Federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent I will not hesitate in bringing legal action against you for the following:
Violation of the Fair Credit Reporting Act
Violation of the Fair Debt Collection Practices Act
Defamation of Character

I am writing to see if you would be willing to make a “goodwill” adjustment to your reporting to the three credit reporting agencies. Provida Life Sciences placed the above referenced account with you for collections in 2004. I paid the account in full on February 21, 2006.
Because I have paid the account in full, I would like you to consider deleting the account from your records and stop reporting to the three credit reporting agencies. At the time that I ordered the products from Provida Life Sciences, I was not even 18 years old yet. I had a problem with my bank account and had to close it, which meant that Provida could not withdraw the monthly payments that I had agreed to when I ordered the products. Because I never received any subsequent billings from Provida, I naively thought that I did not have to pay for it. I mention this not to justify neglecting to make timely payments, but to show that my irresponsible behavior as a teen-aged child is not an good indication of my actual creditworthiness. I understand that this is an unusual request–particularly as the account was in collections for some time before I paid it.
The 1st Nationwide Collection Agency representatives that I have spoken with over this time period were always very cordial with me. I have heard horror stories about aggressive collections agencies who will stop at nothing to collect a debt. I am happy to say that I did not have an experience like that with 1st Nationwide. When the subject comes up, I often mention how impressed I am by how courteous and respectful your representatives have been to me. I appreciate your patience during this time of learning for me. As I have gotten older, I have become more and more aware of the need to honor my financial obligations, which is why I paid the account in full in February 2006. I have also maintained excellent payment records with all of my creditors; I have never had a single late payment on any of my other accounts.
I have been married for a year now, and my husband and I are about to begin the process of buying our first home. This collection account on my credit report is having a negative impact on my FICO score. which may prevent me from being able to secure financing for a home purchase, or it may greatly increase the cost of doing so. Since this collection account is not a reflection of my current creditworthiness, I am requesting that you give me a second chance by deleting this account. Your customer service representative Eric (extension 1306) suggested that I submit this request in writing. I sincerely hope that there is redemption at 1st Nationwide Collection Agency, and I beg you for such consideration. We have three late payments on the above referenced account that date back to 2006. Since that time we have been exceptional customers paying every month on time and never 30 days late.
Because of our exceptional payment history over the last year, we would like you to consider removing the negative payments from our credit reports. At the time of the late payments, we had just moved into our new home in January 2006 and with me being self-employed really affected our finances as with the move many of my clients decided to take their children to other facilities because we had moved.
